Privacy Policy for the Management of Personal Information
This document describes the privacy policy of Sonder Minds Psychology (ABN: 50 746 512 568) for the management of clients’ personal information. The psychological services provided are bound by the legal requirements of the Australian Privacy Principles set out in the Privacy Act 1988 (Cth).
Client information
Client information is held in:
an encrypted, cloud-based practice management system (Halaxy) with medical-grade security; and
secure business email and electronic systems used in the provision of psychological services.
These records are only accessible to authorised persons involved in providing or administering your psychological care. The information held on each file may include personal information such as your name, address, date of birth, contact details, Medicare information, referral information, medical history, correspondence, clinical notes, assessment information and other personal information collected as part of providing psychological services. Personal information may also be collected through our website contact form. Our website is hosted by Squarespace, which processes and securely stores website enquiry submissions to enable the operation of our website and facilitate communication with prospective clients. A copy of each website enquiry is also sent to our secure business email address. Google reCAPTCHA is used to assist in protecting our website from spam and fraudulent submissions.
How Clients' Personal Information is Collected
A client's personal information is collected in a number of ways during psychological consultation.
These include when the client:
completes forms;
provides information directly during appointments;
communicates by telephone or email;
submits an enquiry through the practice website;
interacts with administrative staff;
provides information through correspondence; or
when other health practitioners or third parties provide information via referrals, reports or correspondence.
We only collect personal information that is reasonably necessary for the provision of psychological services.
Consequences of Not Providing Personal Information
If a client does not wish for their personal information to be collected in a way anticipated by this Privacy Policy, Sonder Minds Psychology may not be in a position to provide psychological services to the client. Submitting an enquiry through our website does not establish a psychologist–client relationship. A therapeutic relationship is only established once an appointment has been offered, accepted and informed consent has been obtained.
Purpose of Holding Personal Information
A client's personal information is gathered and used for the purpose of providing psychological services, including assessing, diagnosing and treating a client's presenting concerns.
The personal information is retained to document what occurs during sessions, facilitate communication, comply with legal and professional obligations, and enable the psychologist to provide an appropriate and informed psychological service.
Information submitted through our website is used only for the purpose of responding to enquiries and arranging appointments where appropriate.
Disclosure of Personal Information
All personal information gathered during the provision of psychological services will remain confidential except when:
it is subpoenaed by a court, or disclosure is otherwise required or authorised by law; or
failure to disclose the information would, in the reasonable belief of the psychologist, place the client or another person at serious risk to life, health or safety; or
the client's consent, or the consent of a parent or guardian who is legally authorised to act on their behalf, has been obtained to:
a) provide a written report to another agency or professional (e.g., a GP, psychiatrist, paediatrician or lawyer);
b) discuss the material with another person (e.g., a parent, employer, health provider or third-party funder);
c) clinical consultation with another professional is required to provide better clinical services (identifying details will remain confidential)
d) disclose the information in another way; or
e) disclose information to another professional or agency (e.g., GP) where the disclosure is directly related to the primary purpose for which the information was collected.
Personal information submitted through our website may be processed or stored by Squarespace, an international website service provider whose servers may be located outside Australia. Reasonable steps are taken to ensure that third-party service providers maintain appropriate privacy and security standards.
Otherwise, clients' personal information is not disclosed to overseas recipients unless the client consents or such disclosure is otherwise required by law.
Clients' personal information will not be used, sold, rented or disclosed for any other purpose.
In the event that unauthorised access, disclosure or loss of a client's personal information occurs, the psychologist will activate a data breach response plan and use all reasonable endeavours to minimise the risk of serious harm.
Requests for access and correction to client information
At any stage a client may request to see and correct the personal information about them kept on file. The psychologist may discuss the contents with them and/or give them a copy, subject to the exceptions in the Privacy Act 1988 (Cth). If satisfied that personal information is inaccurate, out of date or incomplete, reasonable steps will be taken in the circumstances to ensure that this information is corrected. All requests by clients for access to or correction of personal information held about them should be lodged with Sonder Minds Psychology. These requests will be responded to in writing within 21 days, and an appointment will be made if necessary for clarification purposes.
